Please read these terms carefully. Sections 12 to 15 and 18:

• limit our liability;
• make you responsible for claims caused by your content or conduct;
• and, where the law allows, shorten the time to bring a claim and rule out class actions.

1. Agreement

• These terms are an agreement between you and PersianChords.com ("the site", "we", "us"). "We" includes the site's owner and anyone acting on the owner's behalf to run the site.
• By using the site, you agree to these terms, the privacy policy (/privacy) and the community guidelines (/guidelines). If you don't agree, don't use the site.
• When you create an account, you accept these terms explicitly.

2. The site

• PersianChords.com is a free chords bank of Persian songs. Players add songs and versions, and the site makes them available.
• Reading, searching and playing need no account.
• We aim to keep the chords bank free. But we may change, suspend or stop the site or any part of it at any time, with or without notice, and without liability to you. Nothing in these terms obliges us to keep offering the site or any feature.

3. Using the site

You may use the site to learn, practise, teach and perform music. You must not:

• attack the site: overload it, probe it for weaknesses, get around its limits or security, or interfere with other people's use;
• automate accounts or actions: scripted sign-ups, votes, comments, requests or reports. Automated reading that follows robots.txt and doesn't strain the site is allowed;
• collect other people's data: gather personal information about other users;
• misrepresent yourself or us: pretend to be another person or the site, or use the site's name or logo to suggest we endorse you;
• break the law or the rules: use the site unlawfully, help anyone else do so, or post anything that breaks these terms or the guidelines.

4. Songs, lyrics and chords

• Rights. Song lyrics and music belong to their writers, composers and other rights holders. The site claims no ownership of any song and no credit for any chord.
• Who provides the content. Users and other sources provide it. We don't check it before it appears, apart from the review steps in section 8, and we don't endorse it.
• Accuracy. Chords, lyrics and other information may be wrong or incomplete.
• Your risk. You use the content at your own risk.

5. Accounts

• Age: you must be at least 16 years old.
• One person, one account. You may not share your account, or hold more than one.
• Your responsibility. You are responsible for everything done through your account, and for keeping your email account secure.
• What we may do with accounts: refuse an account, reclaim or change a username, or remove a name we find unsuitable.
• Names. Usernames and display names are public. They must not:
  • impersonate anyone;
  • suggest you speak for the site;
  • be offensive;
  • contain contact details or links.

6. Your content

"Your content" means anything you add:

• songs, versions and song requests;
• reports;
• any other submission.

You are solely responsible for your content. You confirm that:

• you have the right to share it. You created it yourself, or you have all the rights and permissions needed to share it under these terms. For chords and edits, you worked them out yourself and did not copy them from other websites, books or apps.
• it is lawful: it does not infringe anyone's copyright or other rights, and it is not unlawful;
• it is honest: it is accurate to the best of your knowledge, and your votes and feedback reflect your real view;
• it follows the rules: it complies with the community guidelines.

We have no obligation to monitor content, but we may.

7. The license you give us

You keep any rights you have in your content. You grant us a license to it on these terms:

• Scope. The license is non-exclusive, worldwide, royalty-free, fully paid, perpetual, irrevocable, transferable and sublicensable.
• What it allows. We may use, host, store, reproduce, modify, adapt, translate, format, transpose, simplify, combine, publish, display, distribute and make derivative works of your content. We may do this in any form or medium, now known or later developed, to run, improve and promote the site.
• Who else may use it. The license extends to our service providers and to any successor to the site.
• How long it lasts. It continues after you delete the content or your account.

• Moral rights. To the extent the law allows, you waive, and agree not to assert, any moral rights in your content, including any right to be named. The site shows your name only if you opt in to credit (section 10).
• Feedback about the site. If you send ideas or suggestions about the site, we may use them freely, without any obligation to you.

8. Review, moderation and enforcement

• Our discretion over content. To the extent the law allows, we may at any time, without notice and without liability:
  • refuse, remove, hide, edit or restore any content;
  • limit, suspend or close any account;

  for any reason, including a breach of these terms or the guidelines. We don't have to explain a decision.

• Review. Songs and versions appear only after our review, and we may reject any of them.
• Asking us to reconsider. You may ask us to reconsider a decision by writing to us. We may review it, but we are not obliged to change it.

9. Limits

We set limits on submissions, comments, requests, votes and other activity, and we may change them at any time. The current limits are listed in the guidelines.

10. Credit and compensation

• Credit is optional and off by default. If you opt in, your username appears on what you contributed. If you opt out or delete your account, it is removed.
• No other credit or attribution is owed to you.
• No payment. You receive no payment or compensation of any kind for your content. You do not pay to use the site.

11. Rights concerns and takedown

If you believe content on the site infringes your rights, write to contact@persianchords.com and include:

• the work or right concerned;
• the page address;
• how to reach you;
• a statement that you believe in good faith the use is not authorized;
• a statement that your notice is accurate and that you are the rights holder or are authorized to act for them;
• your name as signature.

What happens next:

• We may remove or disable the content promptly, without first checking the claim.
• If the content came from a user, we may tell them. They may send a counter-notice.
• Accounts that repeatedly infringe rights are closed.
• Anyone who sends a false or misleading notice is responsible for the consequences.

12. Disclaimer of warranties

To the fullest extent the law allows, the site and all content are provided "as is", "as available" and "with all faults", without warranties of any kind, express or implied.

This includes, without limit, any warranty of:

• merchantability;
• fitness for a particular purpose;
• title or non-infringement;
• accuracy;
• availability;
• security.

We do not warrant that:

• the site will be uninterrupted, secure or free of errors or harmful components;
• any content is correct, complete, lawful or safe;
• any content you add will be kept.

We are not responsible for third-party services the site uses or links to.

13. Limitation of liability

To the fullest extent the law allows:

• Neither PersianChords.com nor its owner, nor anyone acting on their behalf, is liable for any:
  • indirect, incidental, special, consequential, exemplary or punitive damages;
  • loss of data, profits, revenue, goodwill or opportunity;

  arising from or related to the site, its content, these terms, or the conduct or content of any user or third party. This applies even if we were told such damage was possible.

• We are not liable for:
  • unauthorized access to the site or your data;
  • interruptions or errors;
  • anything outside our reasonable control.
• Our total liability for all claims related to the site is limited to the greater of what you paid us in the 12 months before the claim (for this free site, nothing) and 10 US dollars.

These limits apply whatever the legal theory, whether contract, tort (including negligence) or anything else. They do not limit liability that the law does not allow to be limited.

14. Indemnity

To the fullest extent the law allows, you will defend, indemnify and hold harmless PersianChords.com, its owner, and anyone acting on their behalf.

• What it covers: all claims, damages, losses, liabilities, costs and expenses, including reasonable legal fees.
• What triggers it:
  • your content;
  • your use of the site;
  • your breach of these terms or the guidelines;
  • your violation of any law or of anyone's rights.
• Defending a claim: we may take over the defence of any such claim, and you will cooperate with us.

15. Disputes between users

We are not responsible for disputes between users. To the extent the law allows, you release PersianChords.com and its owner from all claims arising from them.

16. Ending

• You may stop using the site, or delete your account, at any time.
• We may suspend or end your access at any time, as described in section 8.
• What survives: sections 4, 6, 7 and 10 to 19 continue after your access ends.

17. Changes to these terms

• We may change these terms at any time. We post the new version with its date. It applies from when it is posted, unless it says otherwise.
• Notice. We may also announce significant changes on the site.
• Acceptance. We may ask account holders to accept the changed terms.
• If you don't agree, stop using the site and delete your account. Continuing to use the site means you accept the new terms.

18. Disputes and governing law

• Write to us first. Before starting any legal claim, you will write to us and allow 30 days to resolve it informally.
• Governing law. These terms are governed by the laws of the place where the site's owner is established, without regard to conflict-of-law rules. Its courts have exclusive jurisdiction.
• No class actions. To the extent the law allows, claims may be brought only individually, not as a class, collective or representative action.
• One-year limit. To the extent the law allows, any claim must be brought within one year after it arose, or it is permanently barred.
• Your local protections. None of this removes protection that the law of your country of residence gives you and that cannot be waived by agreement.

19. General

• Entire agreement. These terms, the privacy policy and the guidelines are the entire agreement between you and us about the site.
• Severability. If any part of these terms is found unenforceable, it is enforced as far as possible, and the rest stays in force.
• No waiver. If we don't enforce a right, we don't waive it.
• Transfer.
  • We may transfer these terms and the site, for example to a non-profit or other successor.
  • You may not transfer your rights or obligations.
• Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
• Language and headings. These terms are published in Persian and English, and the English version prevails. Headings are for convenience only.
